The following Digital Product Terms ("Terms") are entered into by and between You and Finding Nine ("Company," "we" or "us"). These Terms govern your access to and use of any digital products, downloadable content, or other digital resources offered by Finding Nine, whether free or purchased ("Digital Products").

By accessing, downloading, or purchasing any Digital Product, you agree to be bound by these Terms. If you disagree with any part of these Terms, do not access or purchase our Digital Products.

These Terms should be read in conjunction with our Terms and Conditions, Privacy Policy, and Disclaimers, all of which are incorporated herein by reference.

DIGITAL PRODUCTS DEFINED

"Digital Products" include all downloadable and digitally delivered content offered by Finding Nine, including but not limited to PDF guides, workbooks, templates, spreadsheets, checklists, audio files, video files, and any other digital resources, whether provided free of charge or for purchase.

FREE DOWNLOADABLE CONTENT

We may make certain Digital Products accessible at no charge in exchange for providing your email address or other contact information ("Free Content"). By accessing Free Content, you agree to the following:

We grant you a limited, personal, non-exclusive, non-transferable license to use Free Content for your own personal or internal business use. You may not modify, copy, reproduce, create derivative works of, reverse engineer, alter, enhance, resell, redistribute, or in any way exploit Free Content without our prior written consent. You may not offer any competing products or services based upon any information contained in the Free Content.

PURCHASED DIGITAL PRODUCTS

Upon completing a purchase of a Digital Product, we grant you a limited, personal, non-exclusive, non-transferable license to use the purchased Digital Product for your own personal or internal business use, subject to these Terms.

Delivery. Purchased Digital Products are delivered digitally via email following completion of your purchase. No physical product will be shipped. You are responsible for providing a valid email address at checkout and for ensuring that you have the necessary software and equipment to access and use your Digital Product. We are not responsible for your inability to access a Digital Product due to technical limitations, incorrect contact information provided at checkout, or email delivery issues caused by your email provider or spam filters.

No Sharing or Resale. Purchased Digital Products are for your individual use only. You may not share, resell, redistribute, sublicense, copy, or reproduce any purchased Digital Product in whole or in part, by any means or in any format, without our prior written consent. Unauthorized sharing or distribution of our Digital Products is a violation of these Terms and applicable copyright law and may result in legal action.

No Modifications. You may not modify, edit, alter, or create derivative works based on any purchased Digital Product without our prior written consent.

REFUND POLICY

Due to the instant-access, digital nature of our products, all sales are final. We do not offer refunds, exchanges, or credits for Digital Products once a purchase has been completed and access has been granted.

By completing your purchase, you acknowledge that you have read the product description, understand what you are purchasing, and agree that no refund will be issued. We encourage you to review all product descriptions carefully and contact us with any questions before purchasing.

In the event of a duplicate charge or a documented technical failure that prevented delivery of your Digital Product, please contact us at hello@findingnine.com within 7 days of your purchase date and we will work to resolve the issue promptly.

Chargebacks or payment disputes filed contrary to this refund policy will be contested. Finding Nine reserves the right to revoke access to any Digital Product and terminate your license in the event of a disputed charge.

INTELLECTUAL PROPERTY

All Digital Products and their contents are the intellectual property of Finding Nine and are protected by applicable copyright, trademark, and other intellectual property laws. Your purchase of or access to a Digital Product does not transfer any ownership rights to you. All rights not expressly granted in these Terms are reserved by Finding Nine.

NO WARRANTIES

Digital Products are provided "as is" and "as available" without warranty of any kind, express or implied. We make no representations or warranties regarding the accuracy, completeness, or fitness for a particular purpose of any Digital Product. Results described in or implied by our Digital Products are not guaranteed and will vary based on individual effort, circumstances, and other factors outside our control.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Finding Nine shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your access to or use of any Digital Product. In no event shall our total liability to you exceed the total purchase price paid for the Digital Product in question.

CHANGED TERMS

We reserve the right to update these Terms at any time. The date of the most recent revision will be indicated by the "Last Updated" date at the top of this page. Your continued access to or use of our Digital Products following any changes constitutes your acceptance of the revised Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Johnson County, Kansas.
